DRI had begun issuing notices to exporters in the previous few months, elevating questions round advantages claimed below the GST framework for advance authorisation scheme.
The scheme primarily permits exporters to say credit score of uncooked supplies purchased earlier than really exporting the product.
“The restriction to claim benefit of IGST (integrated GST) exemption to advance authorisation licence holders has been imposed by way of rules and creates a distinction between two classes of Indian exporters. Accordingly, judicial review of such a restriction will have to be decided by the courts,” mentioned Abhishek A Rastogi, companion at Khaitan & Co, who’s representing some exporters within the Gujarat High Court.
The exporters had been requested to pay IGST first because the overseas commerce coverage has been amended and several other notifications had been issued in the previous few months.
